Another Wirecard criminal court proceeding today in Munich, following a weeks-long suspension to read court-protected evidence. Witnesses today: Ivan Montik from B2B gambling provider Direx, and a former Wirecard employee responsible for correct invoicing/PO's.
The interrogation of the two Wirecard witnesses was short, today's proceeding ended at about noontime.
First, Direx CEO Ivan Montik was asked for about an hour about his business model. Montik explained that he provided software services for many Casinos in a B2B form, he explained he wasn't a Payment Service Provider (PSP), but acquired casino licenses in various locations and forwarded income from online gaming acquired through Wirecard's services to his Casino clients.
The judge did not want to accept that Direx wasn't a PSP, lecturing the witness that "he knows by now what a PSP is and what not".
Montik stated that Direx NV was formerly named Softswiss NV, the name change ocurred in 2016, the company is currently named Dama NV, all previously/currently headquartered in Curaçao.
Main contact point for the Direx CEO at Wirecard was Martin Osterloh, Montik did not know Jan Marsalek, had seen Oliver Bellenhaus for the first time ever here in court today, and did not know 99% of all spicy Wirecard related companies like CQR, Firstline, Pittodrie, and more.
When confronted by the defense of Dr. Braun with a list of payments totaling 422 million euros into Direx, which were sent out in repeating regular rounded payments from Direx accounts, the Wirecard witness stated Direx had about 3000 employees and he had no knowledge of these payments.
He stated a certain Ivan Schubowski (or similar) was finance director during the related timeframe and would need to be asked regarding these money flows.
At around 10:40 a.m., the second witness was sworn in: Ilona Kiefl, former invoicing and purchase order manager at Wirecard.
She came to Wirecard in 2013 and looked over all invoices whether these were properly crafted before they were forwarded to the accounting department.
She stated she had usually received on Fridays many larger invoices coming from Jan Marsalek's personal assistant Sabine Heinzinger.
It was mostly her superior Mr. Elsner who notified the witness that invoices were fully signed by the respective managers.
von Erffa asked the Wirecard witness, whether only digital signatures were provided, or also paper documents with physical signatures clearing the partly very high invoices.
Kiefl stated after thinking for a longer time that there was a rack near her place where these physical documents were stored, she added "but not all invoice clearances were supplied with signatures on paper".
The witness was released after about 1.5 hours, which is when today's proceeding ended as well.
As an important add-on of this week's Wirecard witness, Direx CEO Ivan Montik stated they chose Wirecard as their payment service provider back then because it was a reliable and long-time industry giant, which was even promoted by Angela Merkel.
