The "Apple Puree Break" and the Judge’s Russia Reflex (A moment perfectly illustrating courtroom narrative manipulation)

The baby needed apple puree outside the courtroom. Witness Michaela Krassl, also the child’s mother, tended to her infant.
Presiding Judge Markus Födisch used the brief pause to address procedural matters. Defense attorneys for von Erffa again inquired about an anonymous ProtonMail whistleblower whose identity they sought through a mutual legal assistance request. Leaning into his microphone with audible scorn, Födisch dropped this remark into the courtroom:
"They’re based in Switzerland now, not Russia anymore."
Not shouted, but loud and clear enough for the back row to hear. A ripple of laughter spread through the gallery – the point landed.
Except: ProtonMail was never in Russia!
Founded in 2014 by CERN scientists in Geneva. Always Swiss-based. Always Swiss servers. Always Swiss jurisdiction. Zero historical ties to Russia – at no point.
Födisch wearily doubled down (as he had repeatedly in early 2025 regarding Swiss witnesses tied to the €340 million Wirecard funds routed there), explaining yet again in an almost bored tone that legal assistance requests to Switzerland were pointless. The matter had been settled: With ProtonMail, there was "little to be done." No recent logins existed anyway. And even if someone had logged in, they’d obviously used a VPN – "then it’s all over regardless."
The same refrain as March and April: Switzerland = black hole. Case closed.
Yet the most obvious question remained unasked: If logins did occur, why not simply request the associated IP addresses from the relevant VPN providers (mostly located outside Switzerland)? But no – for the judge, the matter ended before it began.
A single calculated half-sentence and a tired monologue – and the courtroom absorbed the message: Anonymous ProtonMails = shady business. Likely Russian-inspired. And fundamentally untraceable.
As the sleeping child finally drifted off peacefully outside, Judge Födisch demonstrated once more:
Sometimes, a small targeted dig is all it takes to set the narrative for the entire day.
And Switzerland remains cast as an impenetrable wall – which it is regarding ProtonMail, just not for the reasons implied here.
